Terms of Service

These Terms are an agreement between you and EarnVideo LLC. “EarnVideo,” “earn.video,” “we,” and “us” refer to EarnVideo LLC. These Terms govern access to earn.video by creators, sponsors, and participating organizations. Please read them before creating an account, supplying content, accepting an offer, or funding a campaign.

Service and acceptance

earn.video helps creators and sponsors produce in-scene sponsorships. Creators can submit footage, receive one best eligible offer, review an edited version, authorize its publication, and earn under the offer terms they accept. Sponsors can configure and fund campaigns, supply assets, and review delivery and available performance information.

earn.video provides a technology service that connects creators and sponsors. Sponsors are the advertisers of the sponsored content and are responsible for the claims and campaign instructions they supply. Creators control the footage they submit and whether a sponsored version is published. Except as described in these Terms, EarnVideo LLC is not a party to any agreement between a creator and a sponsor.

By creating an account or using the service, you agree to these Terms and the Privacy Policy. If you use earn.video for an organization, you confirm that you are authorized to agree on its behalf.

Eligibility, accounts, and organizations

You must be at least 18 years old to create an account, join the waitlist, or use the service, and legally able to enter into a binding contract, and you must provide accurate account information. You may not use the service if applicable law prohibits you from doing so.

Keep your credentials secure and tell us promptly if you believe your account has been compromised.

Creator access may be limited to invited pilot participants. Sponsor accounts may include organizations with owners, administrators, and members. The organization is responsible for activity performed by its authorized users.

Creator footage and required rights

You retain ownership of footage you submit. You grant earn.video a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, modify, create derivative works from, display, distribute, and sublicense to our service providers the footage you submit and the sponsored edits created from it, as needed to provide the service and fulfill the offers you accept.

You represent and warrant that:

  • you own or have all rights needed for the footage and everything it contains, including music, locations, products, and other material;
  • you have obtained all necessary consents or releases from every identifiable person who appears; and
  • creating, editing, and publishing a sponsored version of the footage is permitted.

Do not include music unless you have the rights needed for commercial use. An approved placement does not authorize a sponsor to reuse your video or identity in paid advertising or another channel unless the accepted offer expressly grants that right. earn.video does not add invented speech, product claims, or likeness permissions to an offer.

Offers, funding, generated edits, and approval

An upload may receive one eligible offer or no offer. Matching depends on funded campaign requirements, contextual fit, available assets, and supported placement conditions. No match is a normal outcome and does not create a payment obligation.

The offer shown to a creator contains the applicable campaign terms, including compensation conditions and any cap. Accepting the offer freezes that version of the terms for the video. Later campaign changes do not replace the accepted offer terms.

Edits may be AI-assisted and may contain mistakes. Creators should review the complete edited video before approving or otherwise authorizing its publication. Nothing publishes through the earn.video workflow unless the creator approves the publication or separately authorizes earn.video to publish on their behalf.

Sponsored exports may include disclosure labels, provenance information, or other notices required by law or platform rules. Creators must not remove, obscure, alter, or circumvent these notices, and must enable any required platform disclosure, such as a branded-content or AI-use setting, when publishing.

Publishing, metrics, earnings, and payouts

Creators control whether and where a sponsored video is published. Creators publish videos themselves or separately authorize a supported publishing feature, and provide the information needed to verify the post.

Earnings arise only under accepted offer terms and after the required publication and verification conditions are met. Payout timing, limits, and any adjustments are governed by those terms.

Platform metrics may be delayed, partial, corrected, or unavailable. Missing data is treated as unavailable, not as zero. Connecting a social account does not guarantee access to any particular metric or prove that a sponsor placement was viewed.

Earnings are based on legitimate views and engagement. A legitimate view is a view from a real person that is not produced by bots, automation, paid or incentivized engagement, or other artificial or fraudulent means. We may correct earnings and settlements as measurement data is corrected or invalidated.

We may withhold affected earnings during a reasonable investigation. After review, we may reduce, reverse, or recover amounts attributable to fraud, artificial or falsified engagement, infringement of third-party rights, or a platform's enforcement of its content policies that causes the sponsored post to fail the conditions of the accepted offer. This includes removal or restriction by platforms such as YouTube or TikTok. A platform action alone is not conclusive evidence of fraud and does not automatically forfeit unrelated earnings.

Settled payouts are final except for the affected amounts described above or amounts that must be recovered under applicable law. To the extent permitted by law, we may offset those amounts against unpaid or future earnings, or require repayment of overpayments already received. Where practicable, we will use an offset before seeking repayment. This provision does not by itself authorize a debit from your bank account or payment card.

We will notify you of the reason and amount of an adjustment or recovery, unless legally prohibited. You may dispute it by contacting support@earn.video and providing relevant information. We will consider corrected findings and platform reinstatements and make any corresponding earnings correction. These provisions do not retroactively change the terms of an accepted offer.

You must not use bots, automation, paid promotion, engagement exchanges, or other artificial means to increase views or engagement, and you must not hide or misrepresent a post's performance. A post used to earn must stay public and accurately measurable for the period the campaign requires.

Payments are handled by our payment providers. For card-network rules and payment settlement purposes only, EarnVideo LLC acts as the merchant of record. For all other purposes, the sponsor is the supplier and advertiser of its sponsored content and remains responsible for it, and creators remain responsible for their footage and publication choices.

Creators are independent contractors, not employees of EarnVideo LLC. Creators are responsible for their own taxes, and EarnVideo LLC may collect tax information and issue tax forms as required by law.

Prohibited use and content

You may not use earn.video to:

  • submit or publish illegal, exploitative, or harmful material, including content that sexually exploits a minor, non-consensual intimate imagery, human trafficking, terrorism or violent extremism, or content that is harassing, hateful, or defamatory;
  • supply material you do not have the rights to use, or use another person's name, voice, image, or likeness without consent;
  • misrepresent product claims, publication, performance, identity, or rights, or create fake endorsements, testimonials, or reviews;
  • remove, obscure, or circumvent required disclosures, review, approval, verification, security, or payment controls;
  • interfere with, scrape, reverse engineer, or disrupt the service; or
  • access another account or impersonate another person or organization.

For six months after a brand or creator is introduced to you through earn.video, do not negotiate or complete a sponsored deal with that party outside the service to avoid fees.

We may remove content, preserve it, and report apparent illegal content to law enforcement or the National Center for Missing & Exploited Children, and we may cooperate with lawful requests.

Creators and sponsors remain responsible for disclosures and other legal obligations that apply to sponsored content and advertising.

Suspension and termination

We may restrict, suspend, or close access when reasonably necessary to protect people or the service, comply with law, investigate misuse, enforce these Terms, or operate a limited pilot. You may stop using the service at any time.

Account closure does not erase obligations or rights that arose under an accepted offer. Funds, publications, records, and disputes already in progress may continue to be handled as needed to complete or unwind those transactions.

We may also remove or restrict content, hold or reverse payouts while we investigate, and cooperate with law enforcement. Provisions that by their nature should survive termination, including licenses, warranties, disclaimers, liability limits, and dispute terms, continue to apply.

Third-party services and availability

earn.video relies on third-party services for functions such as authentication, hosting, storage, analysis, rendering, social data, and payments. Those providers operate under their own terms and may change, limit, or discontinue their services.

When you publish content to a third-party platform, that platform's terms and policies apply in addition to these Terms. Creators are responsible for complying with them, including branded-content, AI-disclosure, music, and advertising rules.

Features may change as the service develops. We do not guarantee that matching, rendering, publishing support, metrics, or any integration will always be available or error-free.

Disclaimers

To the extent permitted by law, earn.video is provided “as is” and “as available.” We do not guarantee an offer, successful edit, publication, metric, audience result, campaign delivery, or level of earnings. Creators remain responsible for reviewing edits before approval.

Edits are produced with automated and AI-assisted tools and may be inaccurate or unsuitable. We do not warrant that any edit complies with every law, platform rule, or brand guideline in every jurisdiction. Creators are responsible for reviewing an edit and for the decision to publish it.

Liability, responsibility, and disputes

To the extent permitted by law, earn.video is not responsible for indirect, incidental, special, consequential, or punitive damages, or for losses caused by third-party services, unauthorized supplied material, or a user's failure to review an edit.

Creators are responsible for their footage and publication choices. Sponsors are responsible for their assets, instructions, funding, and claims. Each party is responsible for harm caused by material it did not have the right to supply or instructions it was not entitled to give.

These Terms do not create rights for anyone other than you and EarnVideo LLC. No other person or organization, including a brand, talent, or other rights holder, may enforce them, except that earn.video's officers, directors, employees, and agents may enforce the indemnity.

Applicable law determines any rights or remedies that cannot be limited by these Terms.

Limitation of liability

To the fullest extent permitted by law, EarnVideo LLC's total aggregate liability arising out of or relating to these Terms will not exceed the greater of (a) the total amounts you paid to EarnVideo LLC in the twelve months before the event giving rise to the claim or (b) five hundred U.S. dollars (US $500). This limit does not apply to EarnVideo LLC's obligation to pay amounts due under an accepted offer, or to liability that cannot be limited under applicable law.

Indemnity

You will defend, indemnify, and hold harmless EarnVideo LLC and its officers, directors, employees, and agents from and against third-party claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) footage, content, or assets you supply; (b) your breach of these Terms or of a representation or warranty; (c) your violation of law or of another party's rights; or (d) for sponsors, your campaign instructions or claims. This does not apply to the extent a claim results from EarnVideo LLC's gross negligence, willful misconduct, or fraud.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for questions about whether a dispute is arbitrable. Before starting an arbitration, each party will try in good faith to resolve the dispute informally by contacting support@earn.video. Nothing in these Terms limits a right you may have under mandatory law that cannot be waived.

Arbitration agreement

You and EarnVideo LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding, individual arbitration, and not by a class, collective, or representative action.

Rules and place. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules if you are an individual, or its Commercial Arbitration Rules if you are using the service for an organization or business. The arbitration will take place in Florida unless the parties agree otherwise or the arbitrator requires a different location for a fair hearing. A single arbitrator will decide the dispute and may award the same relief a court could. The award is binding and may be entered as a judgment in any court with jurisdiction.

Who decides. The arbitrator, and not a court, will decide questions about the interpretation, validity, and enforceability of this arbitration agreement, including whether a dispute is arbitrable, except that a court will decide whether the class-action waiver below is enforceable.

Class and collective waiver. You and earn.video each waive any right to bring or take part in a class, collective, or representative action, or to combine a dispute with another person's dispute, except through a batch procedure under the AAA rules. If a court finds this waiver unenforceable as to a claim, this arbitration agreement will not apply to that claim and it will proceed in court; the rest of these Terms still applies.

Exceptions. Either party may bring an individual action in small-claims court if it qualifies, seek injunctive or other equitable relief in court to protect intellectual property or the security or integrity of the service, or ask a court to enforce this arbitration agreement.

Fees. If you are an individual, AAA's Consumer Arbitration Rules govern the filing and administrative fees, and earn.video will pay the fees those rules require it to pay. If you are a business, each party pays its own fees and expenses unless the arbitrator decides otherwise.

Your right to opt out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing support@earn.video with your name and a clear statement that you opt out. If you opt out, disputes will be resolved in the state or federal courts located in Florida, and each party consents to venue there. Opting out does not affect any other part of these Terms.

Many similar claims. If 25 or more similar demands for arbitration are filed against EarnVideo LLC, the parties agree to use the AAA's procedures for multiple consumer cases, or a comparable batching procedure for business users chosen by the arbitrator, to resolve them efficiently.

No jury trial; survival. To the extent a dispute is resolved in court, each party waives any right to a jury trial. This section survives termination of these Terms.

Reporting concerns and rights complaints

If you believe content on earn.video infringes your rights or violates these Terms, including copyright, trademark, right of publicity, or brand concerns, contact support@earn.video with enough detail for us to locate the content. We may remove or restrict content while we review and may ask for more information.

General terms

You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy form the entire agreement between you and EarnVideo LLC about the service, except that accepted offer terms govern the specific sponsorship they cover. These Terms do not create an agency, partnership, or joint venture between you and EarnVideo LLC. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree to receive notices and communications electronically.

Changes and contact

We may update these Terms as the service changes. The page will show the latest update date, and material changes will be presented for acceptance when required before they apply.
